Company

“maya”, “maya mental health”, “mayamentalhealth.com", “company”, “firm”, “organisation”, “we”, “our”, “us” or similar terminology are all in reference to alohomora therapy private limited (or its affiliates and subsidiaries) as a provider of Services for the remainder of this document.

User

“User”, “client”, "customer", “you”, “your” or other similar terminology are all in reference to you as the User of the platform as a recipient of our products, services and resources for the remainder of this document.

Platform

“platform” or similar terminology are all in reference to any website or web links that the User can employ to access services provided by the company.
​

Mental Health Practitioners

“mental health practitioner”, “mental health therapist”, “therapist”, “therapy provider”, “counsellor”, “MHP”, “psychologist”, “trainee”, “service provider” or similar terminology are all in reference to the mental health practitioners.

nature of service

maya is an online mental health platform that provides online mental health services to adults through MHP. These include, but are not restricted to video based therapy to individuals and couples. maya offerings may include/are:

• online therapy with MHP (who have been authorised by maya to use the platform for delivering their services)

• initial assessment/s with in-house psychologists

• workshops and/or webinars delivered by experienced therapists or mental health professionals

• informational tools, content and programmes through a range of channels including, but not restricted to websites and emails

• engaging with the platform through replies, comments, feedback, blogs and any other submissions on the platform;

 

These Services offered by maya are in compliance with our client anonymity and confidentiality policies (refer to Privacy Policy).

maya reserves the right to add or remove products and services from its overall offerings without prior notification.
The aforementioned shall hereinafter be referred to as “Services” or “services”.

disclaimer

maya is not equipped to handle medical or psychological emergencies, including situations where an individual is experiencing thoughts of self-harm, suicide, or symptoms of severe clinical disorders like schizophrenia. In these cases, in-person medical intervention is crucial.

If you're experiencing any of these difficulties, or if you're contemplating suicide or feel that you're a danger to yourself or others, please seek help at the nearest hospital or emergency room. There, you can connect with a psychiatrist, social worker, counsellor, or therapist in person. This also applies to any medical or psychological health emergency.
 

 

conditions of use

By using or purchasing any service, product, or resource from maya, the User confirms that they are at least 18 years old, legally competent to contract under the Indian Contract Act of 1872, and capable of making their own decisions. The User also agrees to our Terms and Conditions (this "User Agreement") and any additional terms, conditions, and policies referenced or linked here.

Please read this User Agreement carefully. It takes effect as soon as you use or purchase anything from maya. Accessing maya on any device, including mobile phones, smartphones, and tablets, is also subject to this User Agreement.

We may add, modify, or remove parts of this User Agreement at any time without notice. Your continued use of maya or purchase of any service, resource, or product after such changes means you accept the revised terms. It is your responsibility to review this User Agreement periodically.
 

 

scope of terms and conditions

The User Agreement, including the Terms of Use and Privacy Policy, applies to all current and future agreements between Users and maya, and supersedes any prior oral or written terms and conditions. 
All Users of the platform, including browsers, vendors, customers, merchants, and content contributors, are subject to the User Agreement. By using our Services, the User agrees to all terms and conditions outlined in the User Agreement and related policies.

termination of agreement

termination by User

Users can terminate this Agreement at any time during the term, provided all outstanding payments are settled, if applicable. Upon termination, some User information may remain on our servers. To remove this information, Users can contact maya at support@mayamentalhealth.com. maya will aim to process such requests within 14 working days, in accordance with our Privacy Policy and applicable laws.

maya may terminate this Agreement at any time without providing a reason. Upon termination, the User must pay any outstanding amounts due to maya within 30 days. Any payments owed to the User will be processed according to our Refund Policy.
 

 

terms of use

By using this platform, you agree to the following terms:
eligibility
You are 18 years of age or older, competent to contract under the Indian Contract Act, 1872, and your use of the platform doesn't violate any laws or regulations.
accurate information
All registration information you provide, either directly to us or through a third-party application, is truthful and accurate, and you will maintain its accuracy.
personal use
Your use of the platform is solely for personal and non-commercial purposes. Any other use is prohibited.
restrictions
Your personal and non-commercial use of the platform is subject to these restrictions:

• You will not modify, decompile, reverse engineer, or disassemble any platform content.

• You will not delete or modify any content, including legal notices, disclaimers, or proprietary notices, that you do not own or have express permission to modify.

• You will not use the platform in any unlawful way or in any way that harms the Company or any other person or entity.

• You will not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, access to the Service, or any platform content without express written permission from maya.

• You will not post, submit, upload, distribute, or transmit any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage the platform, Services, or any connected network, or interfere with any person or entity’s use of the platform or Services.

external links
When you access a link that leaves the platform, the site you enter is not controlled by the Company, and different terms of use and privacy policies may apply. We are not responsible for those sites and reserve the right to disable links from third-party sites to the platform.
fees
You agree to pay all applicable fees on time. Late payments may result in additional charges or interest.
technical specifications
You are responsible for checking the technical specifications required before booking a session or using any other digital offerings.
prohibited content
You may not host, display, upload, modify, publish, transmit, update, or share any information that:

• Belongs to another person and to which you do not have any right.

• Deceives or misleads the addressee about the origin of such messages or communicates any information that is grossly offensive or menacing in nature.

• Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense, or prevents investigation of any offense, or is insulting to any other nation.

 

intellectual property

The contents of this platform are intended for informational purposes only. maya is not liable for any loss or damage incurred by reliance on any part of the platform. Any third-party content on this platform remains the property of its respective owners, and maya does not claim any rights related to it. maya's use of such third-party content adheres to the fair use provisions of Indian copyright law and applicable laws in other jurisdictions. All other content in this document is the copyrighted property of maya. No information, content, or material from the platform and/or Services may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without express written permission from maya.

payment and refunds

The User is responsible for all applicable fees, charges, and telephone/internet service fees/charges incurred while using the platform. By using the platform, the User agrees to pay all applicable fees and charges upfront and authorises maya to automatically deduct charges and fees from payments made when features are accessed.
The Company's Cancellation & Refund Policy governs all cancellations and refunds. maya retains the right to modify any aspect of the Cancellation & Refund Policy, as well as the payment methods, charges, and fees outlined in the services section or other relevant sections on the platform, without prior notification or liability to the User or any third party.

 

privacy policy

The Company's Privacy Policy governs the use of our platform and online resources. Please review the Privacy Policy thoroughly, as maya retains the right to modify it without prior notification or liability.

limitation of liability

maya does not guarantee that you will be accepted as a registered User at maya, or as a client by the mental health practitioners on our platform. maya reserves the right to terminate your registration with our platform at any time without citing a reason.
maya, as a technology platform, facilitates the connection between Users and MHPs. The delivery of professional services hinges on the information shared by the User with the MHP, and maya doesn't guarantee specific outcomes from the therapy. Additionally, maya cannot ensure the consistent availability of the same MHP over time. Upon booking an appointment, maya's role is solely to act as a conduit between the User and the MHP, transmitting the booking details to both parties.

The frequency of therapy sessions will be mutually agreed upon between the User and the MHP. While we strive to maintain a consistent schedule, we cannot guarantee that sessions will always occur at a specific frequency or on the same day of the week, though we will make every effort to accommodate your needs.
Over the course of therapy, the MHP may determine that online therapy or mental health Services are not appropriate for some or all of the User’s mental health needs and accordingly may elect to not provide online therapy or mental health Services to the User. Similarly, the MHP shall be at liberty to decide that additional help is needed for the User and shall choose to bring in an additional MHP.
While maya strives to verify the credentials of each registered MHP, maya is not liable for any misrepresentation or fraudulent credentials or claims made by the MHP. Ensuring the accuracy and reliability of all information provided to maya and Users is the sole responsibility of the MHP.
MHPs, who have a contractual relationship with maya to use our platform to provide Services to Users, are solely responsible for their actions, advice, and information provided. maya is not liable for any damages or losses caused by a MHP, directly or indirectly. Users are responsible for their independent decisions and actions, regardless of any representations by maya or the MHP. Neither maya nor the MHP is responsible for the outcomes of Users' decisions and actions.
maya does not endorse or control any specific medical practices, theories, opinions, viewpoints, or positions on any topic. maya does not offer any warranties, guarantees, or conditions, expressed or implied, regarding any information, advice, or suggestions received from maya, either orally or in writing, through any communication medium or service. The only exceptions are outlined in these terms and conditions.

The content provided via the maya platform and any third-party platforms, or via the Services provided, is intended for general informational purposes only and should not be solely relied upon when making decisions. Users should consult primary, more accurate, more complete or more timely sources of information before making any decisions. Maya is not responsible for any inaccurate, incomplete, or outdated information that may be made available on the maya or third-party platforms and Users assume all risk when relying on the information provided through the Services.
The information provided on this platform may include historical data. This data is not current and is provided solely for reference purposes. We retain the right to modify platform content at any time; however, we are not obligated to update any information. Users are responsible for monitoring platform changes. Downloading or obtaining any content, services, resources, or information through this platform is at the User's discretion and risk. The User is solely responsible for any damage to their computer, other devices, or any data or information loss resulting from such downloads.
We reserve the right to modify or terminate any portion of the platform or the Services offered by the Company for any reason, without notice and without liability to the User or any third-party.
The Company makes no guarantees that the content, information, materials, and functions of the platform and/or Services (including any linked third-party sites or services) will be uninterrupted, timely, secure, error-free, or free from harmful components, nor that defects will be corrected.
At maya, we believe that it is unethical for our MHPs to have dual relationships with current or former clients. Therefore, during and after using our Services, Users are prohibited from having any other type of individual relationship with their MHP. This includes connecting on social and professional networking websites such as Facebook, Instagram, LinkedIn, X and other similar websites. Maintaining clear professional boundaries ensures that you can comfortably resume services with us in the future or refer others to our service without any complications.
You agree to protect, defend, and not hold the Company, its distributors, agents, representatives, authorized Users, resellers, service providers, suppliers, officers, directors, owners, employees, and agents responsible for any losses, damages, liabilities, and costs that come from your use of the platform and Services.
 

 

disclaimer on warranties

You acknowledge and accept that any interactions or issues with the MHP on this platform are solely between you and the MHP. maya and/or the MHP are not liable for any such interactions, associated issues, or outcomes. Engaging with an MHP for mental health services is at your own discretion and risk. All services, content, materials, information, and products are provided “as is” and “as available” without any warranties.
The Services and content are provided without warranty of any kind, whether express, implied, or statutory, by maya and its licensors and affiliates.
We may provide Users with access to third-party tools that we neither monitor nor have any control or input over. These tools may include booking services, audio/video conferencing, communication management, and payment processing. Users acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, conditions, or endorsements. We shall have no liability whatsoever arising from or relating to the User’s use of optional third-party tools. Any use by Users of default, proposed, or optional tools offered through the platform is entirely at the User’s own risk and discretion, and Users should ensure that they are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We are not responsible for the content or accuracy of any third-party materials or websites, or for any other materials, products, or services of third-parties. We do not warrant and will not have any liability or responsibility for any third-party materials or websites. Third-party links on this platform may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these third-party websites.
During the User Agreement's term, we may integrate third-party products or services onto our platform. By using these offerings, you acknowledge that you have reviewed and accepted the third-party provider's terms and conditions. Maya is not responsible for any risks, damages, or liabilities arising from using these third-party products, services, goods, resources, content, or any transactions related to third-party websites. Direct any complaints, claims, concerns, or questions about third-party offerings to the respective third-party provider.

entire agreement

If we fail to exercise or enforce any right or provision of this User Agreement, that will not mean that we waive that right or provision.

This User Agreement, and any policies or operating rules that we post on this platform or in relation to the Services, make up the entire agreement between you and us. It governs your use of the Service and replaces any prior or coexisting agreements, communications, and proposals (whether oral or written) between you and us, including any prior versions of these Terms and Conditions.
 

termination

The responsibilities and financial obligations of both parties that were established before the termination date will remain in effect even after this agreement has been terminated.

This User Agreement will stay in effect unless it is ended by either you or maya. If you want to end this Agreement, you can do so at any time by informing maya that you no longer want to use maya’s Services, or when you stop using maya’s platform. Any outstanding payments must be settled before termination.

We may terminate this agreement at any time without notice and deny you access to our Services (or any part thereof) if, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of this User Agreement. You will remain liable for all amounts due up to and including the date of termination.
 

 

mistakes, inaccuracies, and missing information

Information on our platform or Service may occasionally contain typographical errors, inaccuracies, or omissions related to product/Service descriptions, pricing, promotions, offers, etc. We reserve the right to correct these errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We are under no obligation to update, amend, or clarify information in the Service or on any related website/platform, including pricing information, except as required by law.

 

prohibited uses of the platform and its content

You are prohibited from using the platform or its content to:

• Violate any international, federal, provincial, state, or local regulations, rules, laws, or ordinances.

• Submit false or misleading information.

• Collect or track the personal information of others.

• Spam, phish, pharm, pretext, spider, crawl, or scrape.

• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

• Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.

• Interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

• Solicit others to perform or participate in any unlawful acts.

• Use for any unlawful, obscene, or immoral purpose.

Your use of the Service or any related website/platform may be terminated if you violate any of these prohibited uses

 

indemnification

You are responsible for compensating, defending, and holding harmless maya, our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, employees, and interns against any claim or demand made by a third party, including reasonable attorneys' fees, arising from your breach of this User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. This includes indemnifying maya for any breach in confidentiality. If you access maya through a third-party platform, you are responsible for indemnifying maya against any data breaches that occur due to the actions or negligence of the third-party platform.

 

severability

If any part of this User Agreement is found to be illegal, void, or unenforceable, that part will still be enforced to the fullest extent allowed by law. The unenforceable part will be considered separate from these Terms and Conditions, and this will not affect the validity and enforceability of any other remaining provisions.
 

grievance redressal

If you have any concerns or complaints about our Services, please contact us at support@mayamentalhealth.com. We are committed to providing a resolution within one month of receiving your complaint.
 

jurisdiction

The terms of this User Agreement are governed by Indian law, and the courts of New Delhi, India have exclusive jurisdiction over any disputes arising between the User and maya, including those related to the interpretation of this Agreement.
